In this essay, Feigenbaum examines heterosexism as it functions politically and interpersonally in her own experience. She loosely traces her analysis along the current political climate of the bans on same-sex marriages, using this discussion to introduce and illustrate how heterosexual dominance functions. The author aims throughout to clarify what heterosexism looks like “in action,” and she moves toward providing steps to recognize, name, interrupt, and counter heterosexist privilege.

At a time when there is a health care crisis in the United States, there is widespread appeal to religious healing of various types. Adequate research in this area is limited.Terms such as "ecstasy" are used inconsistently, limiting the usefulness of the term, producing confusion rather than understanding. A cross‐cultural comparative perspective is offered.

As the field of clinical ethics consultation sets standards and moves forward with the Quality Attestation process, questions should be raised about what ethical issues really do arise in practice. There is limited data on the type and number of ethics consultations conducted across different settings. At Loyola University Medical Center, we conducted a retrospective review of our ethics consultations from 2008 through 2013. One hundred fifty-six cases met the eligibility criteria. We analyzed demographic data on these patients and conducted (...) a content analysis of the ethics consultation write-ups coding both the frequency of ethical issues and most significant, or key, ethical issue per case. Patients for whom ethics consultation was requested were typically male, white, between 50 and 69 years old, of non-Hispanic origin, and of Roman Catholic faith. Nearly half were in the intensive care unit and 44.2 % died in the hospital. The most frequent broad ethical categories were decision-making, goals of care/treatment, and end-of-life. More specifically, capacity, patient’s wishes/autonomy, and surrogate decision maker were the most frequent particular ethical issues. The most common key ethical issues were withdrawing/withholding treatment, patient wishes/autonomy, and capacity. Our findings provide additional data to inform the training of clinical ethics consultants regarding the ethical issues that arise in practice. A wider research agenda should be formed to collect and compare data across institutions to improve education and training in our field. (shrink)

Abortion has become such an indispensable part of contemporary experience that even Christians sometimes find it difficult to oppose. Since taking the life in utero has ceased to be regarded as a grave sin and is not always recognized as an unmitigated evil, those who wish to remain faithful to the Word of God struggle to find ways of speaking against killing of the unborn. Some of them, like Erika Bachiochi, seek to beat modern culture at its own game, (...) by representing Catholic teaching on human sexuality as a “right kind” of feminism. However, in her appeal to secular rationality, foregoing the metaphysical commitments of faith and replacing them with the consequentialist reasoning and data from scientific research, she thereby renders her alternative unviable and un-Christian. In response to this failure, I would like to present some Orthodox Christian considerations pointing toward a more wholesome and consistent way forward. (shrink)

This paper focuses on Confucian formulations of personhood and the implications they may have for bioethics and medical practice. We discuss how an appreciation of the Confucian concept of personhood can provide insights into the practice of informed consent and, in particular, the role of family members and physicians in medical decision-making in societies influenced by Confucian culture. We suggest that Western notions of informed consent appear ethically misguided when viewed from a Confucian perspective.

The paper investigates various definitions of the concept of opinion as opposed to factual or evidence-based statements and proposes a taxonomy of opinions expressed in English as identified in selected social media. A discussion situates opinions in the realm of pragmatics and reaches to philosophy of language and cognitive science. The research methodology combines a thorough linguistic analysis of opinions, proposing their multifaceted taxonomy with the automatically generated lexical embeddings of positive and negative lexicon acquired from the analysed opinionated texts. As proposed, the definition of the concept of opinion is best apprehended when looked upon in terms of an opinion event, with a number of necessary conditions on the one hand, and those that are characteristic of an explicit opinion prototype on the other. Lists of opinion discourse markers show their preferential uses either in positive or negative opinionated texts; however, no sets of necessary and/or sufficient opinion markers properties have been acquired from the analysed texts. The conclusions indicate a polysemous understanding of naturally occurring social media opinionated texts and a definitional flexibility of the boundaries around lexical positive and negative types of opinion markers. This article describes research-based role-play on academic integrity. In the role-play, doctoral students negotiated the revision of an institutional integrity policy representing different groups of academics and students. On the one hand, role-play as a teaching method and learning activity demonstrated the difficulty of accommodating different perspectives; on the other, it showed the power and necessity of negotiation in matters that involve value judgments. The role-play is described in detail along with its underlying pedagogical foundations and its contextualisation in a (...) doctoral summer school where it took place. The purpose of the article is to describe how academic integrity was approached through role-play and to discuss theoretical and pedagogical foundations of role-play in teaching academic integrity. Although the article does not describe empirical research on role-play as a teaching method, it demonstrates how role-play in teaching academic integrity was developed based on prior research on the topic. Despite apparent political concern and action—often fuelled by high-profile cases and campaigns—legislative and institutional responses to image-based sexual abuse in the UK have been ad hoc, piecemeal and inconsistent. In practice, victim-survivors are being consistently failed: by the law, by the police and criminal justice system, by traditional and social media, website operators, and by their employers, universities and schools. Drawing on data from the first multi-jurisdictional study of the nature and harms of, and legal/policy responses to, image-based sexual abuse, (...) this article argues for a new joined-up approach that supports victim-survivors of image-based sexual abuse to ‘reclaim control’. It argues for a comprehensive, multi-layered, multi-institutional and multi-agency response, led by a government- and industry-funded online or e-safety organisation, which not only recognises the diversity of victim-survivor experiences and the intersection of image-based sexual abuse with other forms of sexual and gender-based violence and discrimination, but which also enables victim-survivors to reclaim control within and beyond the criminal justice system. Current advances in assisted reproductive technologies aim to promote the health and well-being of future children. They offer the possibility to select embryos with the greatest potential of being born healthy (eg, preimplantation genetic testing) and may someday correct faulty genes responsible for heritable diseases in the embryo (eg, human germline genome modification (HGGM)). Most laws and policy statements surrounding HGGM refer to the notion of ‘serious’ as a core criterion in determining what genetic diseases should be targeted by these (...) technologies. Yet, this notion remains vague and poorly defined, rendering its application challenging and decision making subjective and arbitrary. By way of background, we begin by briefly presenting two conceptual approaches to ‘health’ and ‘disease’: objectivism (ie, based on biological facts) and constructivism (ie, based on human values). The basic challenge under both is sorting out whether and to what extent social and environmental factors have a role in helping to define what qualifies as a ‘serious’ disease beyond the medical criteria. We then focus on how a human rights framework (eg, right to science and right to the highest attainable health) could integrate the concepts of objectivism and constructivism so as to provide guidance for a more actionable consideration of ‘serious’. Ultimately, it could be argued that a human rights framework, by way of its legally binding nature and its globally accepted norms and values, provides a more universal foundation for discussions of the ethical, legal and social implications of emerging or disruptive technologies. The focus of this article is university teachers’ and students’ views of plagiarism, plagiarism detection, and the use of plagiarism detection software as learning support. The data were collected from teachers and students who participated in a pilot project to test plagiarism detection software at a major university in Finland. The data were analysed through factor analysis, T-tests and inductive content analysis. Three distinct reasons for plagiarism were identified: intentional, unintentional and contextual. The teachers did not utilise plagiarism detection to (...) support student learning to any great extent. We discuss the pedagogical implications and suggest that the contextual reasons for plagiarism require focus primarily on study strategies, whereas the intentional reasons require profound discussion about attitudes and conceptions of good learning and university-level study habits. A debate over the possibilities for foundations of knowledge has been a key feature of theoretical discussions in the discipline of International Relations. A number of recent contributions suggest that this debate is still active. This article offers a contribution to this debate by suggesting that the study of complexity may provide a contingent foundation for the study of international relations. On March 27, 1784, Goethe writes to Johann Gottfried Herder: -/- I have found–neither gold nor silver, but what makes me unspeakably happy–the os intermaxillare in the human! With Loder I compared human and animal skulls, came upon its trace, and look, there it is. Only, I beg of you not to mention it, since it must be handled confidentially. (WA 4.6:258). -/- The bone whose discovery so elated Goethe, then called the "intermaxillary bone" but now the "premaxilla," is a (...) pair of cranial bones that are located at the front of the upper jaw and bear the incisors in animals that have these teeth. Goethe expresses happiness in finding this bone specifically in humans, a discovery that opposed the prevailing anatomical opinion at the time. Goethe in the Roman Campagna (1787) – Johann Heinrich Wilhelm Tischbein -/- In his essay that was finished by the end of October 1784 and later given the title, "An Intermaxillary Bone of the Maxilla Is to Be Ascribed to the Human as well as to Animals." Goethe claims, citing the work of J. F. Blumenbach and Petrus Camper, that the bone has recently garnered attention as a "distinguishing mark" between humans and apes (LA 1.9:154). -/- Yet, upon reexamination of these anatomists' works, I argue that Goethe misrepresents their positions and overstates the significance of his discovery, at least in a certain sense: while Camper and Blumenbach do deny the intermaxillary bone to humans, they do not construe its absence as an important distinguishing mark between humans and animals. Not only did Goethe's discovery not have the significance he attributed to it, but also historians of science claim that he did not discover it all: the intermaxillary bone had already been described in the human by several anatomists before him. It would thus seem that Goethe misinterpreted the significance of what he had not found, and that his unspeakable happiness was unwarranted. -/- However, Goethe's discovery holds another, heretofore-unrecognized significance. I argue that it signals a change in his vision of nature to one that criticizes and departs from the anthropocentric ontology that grounded the natural sciences of his time. If this anthropocentricism is not overturned and the foundation of natural science not reconceived, Goethe maintains, then the study of nature will be indefinitely frustrated, always floundering, and never able to progress. In light of this threat, Goethe reconceives the foundation of natural science by developing anonathropocentric concept of nature that attempts to escape the pitfalls of the human-centered perspective. His concept of nature's harmony, which I argue reflects a nonathropocentric visions of nature, requires the revaluation of the terms in which historians have disputed his discovery of the intermaxillary bone; the originality of his discovery cannot be limited to establishing the bone's presence in humans but must be extended to the concept of nature's harmony complementary to it. -/- Goethe's discovery, I conclude, remains valuable and worthy of the excitement it initially incites in him. I show how it responds to a paradox of contemporary natural science in which the objective methods intended to eliminate anthropocentrism from the investigation of nature surreptitiously reintroduced it to that investigation. Furthermore, I argue that Goethe's nonanthropocentric vision of nature and his criticism of anthopocentricism are applicable to current questions in environmental ethics. By undermining the foundation of anthropocentric ethics, Goethe also challenges the present anthropocentric modus operandi that continues to condone the environmentally destructive anthropogenic activities responsible for species extinction, chemical pollution, and the loss of natural habitats and biodiversity, in addition to other signs of the Anthropocene. Comenzamos profundizando en su biografía, para luego estudiar sus análisis del pensamiento védico antiguo, el brāhmaṇa, el upanişad, y el budismo. De esta manera, recorremos diversos desarrollos conceptuales propios de estas tradiciones, intentando comprender las constantes tensiones entre lo discontinuo y lo continuo, lo (...) inagenciado y lo agenciado, lo múltiple y lo Uno, y, finalmente, entre el eternismo y el nihilismo. Recent scholarship has focused on the effects of institutional design and constitutional provisions on human rights protections. Democratic institutions, like other manifestations of credible commitment to human rights, seem to play a role in human rights provisions across the world. Yet, there is still a great deal that we do not know about domestic institutions like the human rights ombudsman, an institution created specifically to protect human rights, on human rights provisions. We conduct an examination of the effects of the (...) human rights ombudsman (which may go by the name Defensor del Pueblo, Procurador de Derechos Humanos, or Comisionado Nacional de Derechos Humanos), on personal integrity violations across Latin America, 1982–2006. We find evidence that this understudied institution had significant and positive impacts on reducing such violations. (shrink)

The aim of this study was to investigate the consequences of the use of text-matching software on teachers’ and students’ conceptions of plagiarism and problems in academic writing. An electronic questionnaire included scale items, structured questions, and open-ended questions. The respondents were 85 teachers and 506 students in a large Finnish university. Methods of analysis included exploratory factor analysis, t-test, and inductive content analysis. Both teachers and students reported increased awareness of plagiarism and improvements in writing habits, as well as (...) concerns and limitations related to the system. The results suggest that teachers are inclined to think of plagiarism as part of a learning process rather an issue of morality, which may have consequences for how they understand the role of text matching. The introduction of text-matching software has supported teachers’ work, but at the same time teachers emphasized their own responsibility in detecting problems in student writing. The survey provides a limited sample of “Case Finland,” where implementation of text-matching software nationwide has been remarkably rapid; it offers a glimpse into one institution’s implementation of a newly introduced policy for mandatory plagiarism detection. Consequentialism is a moral philosophy that maintains that the moral worth of an action is determined by the consequences it has for the welfare of a society. Consequences of model design are a part of the model lifecycle that is often neglected. This paper investigates the issue using system dynamics modeling as an example. Since a system dynamics model is a product of the modeler’s design decisions, the modeler should consider the life cycle consequences of using the model. Seen from (...) a consequentialist perspective, the consequences of policies developed from system dynamics models determine the model’s moral value. This concept is explored by discussing model uncertainty from an engineering perspective. In this perspective, the ethical considerations shift from the behavior of the modeler to the model itself and the model’s inherent uncertainty. When the ethical considerations are taken away from the modeler and directed to what the model does, the ethical boundaries extend beyond the proximity of the model. This discussion renews the ethics conversation in system dynamics by considering this shift in philosophical perspective, and investigates how consequentialist moral philosophy applies to the modeling process and in communicating with decision-makers. A model of social assistance in Norway in the context of immigration pressures illustrates some possibilities for addressing these ethical concerns. Previous research has established that the success of strikes, and social movements more broadly, depends on their ability to garner support from the public. However, there is scant published research investigating the response of the public to strike action by healthcare workers. In this study, we address this gap through a study of public responses to UK nursing strikes in 2022–2023, using a data set drawn from Twitter of more than 2300 publicly available tweets. We focus on negative tweets, investigating (...) which societal discourses social media users draw on to oppose strike action by nurses. Using a combination of corpus‐based approaches and discourse analysis, we identified five categories of opposition: (i) discourse discrediting nurses; (ii) discourse discrediting strikes by nurses; (iii) discourse on the National Health System; (iv) discourse about the fairness of strikers' demands and (v) discourse about potential harmful impact. Our findings show how social media users operationalise wider societal discourses about the nursing profession (e.g., associations with care, gender, vocation and sacrifice) as well as recent crises such as the Covid‐19 pandemic to justify their opposition. The results also provide valuable insights into misconceptions about nursing, strike action and patient harm, which can inform strategies for public communication. (shrink)

​Wie ist das diskursfähige Subjekt im Sinne Habermas zu denken? Unter welchen Bedingungen und Modalitäten entwickelt das Subjekt seine Diskursfähigkeit? Erika Edelmayer arbeitet die Denkfigur des diskursfähigen Subjekts aus der Grundlegung der soziologischen Theorie als „Theorie des kommunikativen Handelns“ heraus. Sie untersucht, was Diskursfähigkeit im Rahmen einer deliberativ verstandenen Demokratie bedeutet und zeigt die Konsequenzen auf, die sich daraus für die Pädagogik ergeben.

Existing whistle-blowing models rely on “cold” economic calculations and cost-benefit analyses to explain the judgments and actions of potential whistle-blowers. I argue that “hot” cognitions – value conflict and emotions – should be added to these models. I propose a model of the whistle-blowing decision process that highlights the reciprocal influence of “hot” and “cold” cognitions and advocate research that explores how value conflict and emotions inform reporting decisions. I draw on the cognitive appraisal approach to emotions and on the (...) social-functional value pluralism model to generate propositions. (shrink)

Can one explain both the resilience of the status quo and the possibility for resistance from a subordinate position? This paper aims to resolve these seemingly incompatible perspectives. By extending Randall Collins's interaction ritual theory, and synthesizing it with Norbert Wiley's model of the self, this paper suggests how the emotional dynamics between people and within the self can explain social inertia as well as the possibility for resistance and change. Diverging from literature on the sociology of emotions that has (...) been concerned with individual emotional processes, this paper considers the collective level in order to explore how movement action is motivated. The emotional dynamics of subordinate positioning that limit women's options in face-to-face interactions are examined, as are the social processes of developing feminist consciousness and a willingness to participate in resistance work. Pointing toward empirical applications, I conclude by suggesting conditions where resistance is likely. (shrink)

Given the various shortcomings of classical phenomenological methods identified by critical and liberatory theorists, this paper considers what phenomenology has to offer theorists of multiply marginalized experience. The paper begins with an account of the major reasons for which Latinx feminists such as Linda Martín Alcoff, Jacqueline Martinez, and Mariana Ortega have found a phenomenological approach useful in their projects. This account reveals that though Latinx feminist phenomenologists have found useful resources for theorizing multiply marginalized theory and identity in the (...) classical texts of phenomenology, experiences unique to those subjected to marginalization remain significantly underdeveloped or absent from classical accounts. Taking seriously the primacy of lived experiences of ‘rupture’, this paper argues, is therefore necessary in the development of a phenomenological approach that does justice to life in the borderlands and the lived experience of being-between-worlds. Informed by the work of Latinx feminist theorists such as Gloria Anzaldúa and María Lugones, this paper closes with a proposed critical feminist phenomenological approach that centers the moment of ‘rupture’ described in such work. Ultimately, this paper argues that the communication and documentation of these ruptures in the form of phenomenological description allows for the examination and interrogation of sedimented logics of oppression on the way to liberatory ends. Abstract:Many scientists argue that the world is becoming increasingly dominated by human activity, much to the detriment of the natural world. In what scholars have dubbed the Anthropocene, the current geological epoch during which time human activity has been the dominating force over climate and the environment, many questions of environmental ethics have arisen. Who does the earth belong to? What is the relationship between humans and the environment? What is the moral standing of non-human life? Locke and Rousseau provide (...) varying answers to these questions, which are central to discussions of environmental ethics. In many ways, Locke and Rousseau's answers are opposed to each other, suggesting a differing world view when it comes to environmental ethics. Locke's understanding of environmental ethics seems to dominate, and perhaps even cause, the onset of the Anthropocene, but Rousseau's response, and a potential turn toward his understanding of environmental ethics marks an ideological shift in the way that humans understand their relationship with the world around them. This paper argues that the writings of Locke and Rousseau correspond to different stages of the Anthropocene with significant effects on both environmental ethics and environmental governance and policy. An absolute decline in US life expectancy in low education whites has alarmed policy makers and attracted media attention. Depending on which studies are correct, low education white women have lost between 3 and 5 years of lifespan; men, between 6 months and 3 years. Although absolute declines in life expectancy are relatively rare, some commentators see the public alarm as reflecting a racist concern for white lives over black ones. How ought we ethically to evaluate this lifespan contraction in (...) low education whites? Should we care, or is it racist to care? Does it constitute an injustice or reflect justice being done? I argue that the lifespan contraction in low education whites violates key normative criteria used to make determinations of health justice, and that these judgments do not vitiate concerns about racism. I conclude with reflections on US population health policy and building an inclusive health equity movement. (shrink)

Critics from a variety of camps have argued that bioethics has suffered an indifference to Cases have been described as thin and the selves inhabiting them hollow. This criticism has been driven at least in part by a reworked conception of the self. The rational and autonomous self that once dominated bioethics discourse has been replaced with a more self, a self embedded in stories, relationships, families, communities, cultures, and other particularitythese differences—matter. They matter because they figure importantly into our (...) ethical analyses of cases, affecting, for example, how we interact with and treat patients. And with this shift has come increasing attention to the processes of moral inquiry that enable inquirers to gather all of this moral information and find their way from complex cases to context-sensitive responses. The study focused on university students' understanding and conceptions of ethical issues in research. Domain-specific and domain-transcending measures were developed to gauge the students' awareness of ethical issues. Responses were obtained from 269 undergraduate and graduate students at a U.S. regional university. Participant withdrawal, the debriefing of research participants, the dissemination of findings, and giving credit to co-contributors were the most challenging ethical issues for the students. Ethical awareness was predicted by professional and organizational socialization, and perspective taking. Contextualization greatly (...) improved the students' ability to recognize ethical issues. Simulations and role-taking are suggested as the means with which to teach students about the ethical issues perceived as challenging. (shrink)
